Art.  42.  [Przedłużenie okresów legalnego pobytu obywateli Ukrainy na terytorium RP]

Art.  42.  [Przedłużenie okresów legalnego pobytu obywateli Ukrainy na terytorium RP]
1. Jeżeli ostatni dzień okresu pobytu obywatela Ukrainy na terytorium Rzeczypospolitej Polskiej na podstawie wizy krajowej przypada w okresie od dnia 24 lutego 2022 r., okres pobytu na podstawie tej wizy oraz okres ważności tej wizy ulegają przedłużeniu z mocy prawa do dnia 31 grudnia 2022 r.
2. W przypadku, o którym mowa w ust. 1, w dokumencie podróży obywatela Ukrainy nie umieszcza się nowej naklejki wizowej.
3. Wiza krajowa w okresie przedłużenia okresu pobytu oraz okresu ważności na podstawie ust. 1 nie uprawnia do przekraczania granicy.
4. Przepisów ust. 2 i 3 nie stosuje się do kierowcy będącego obywatelem Ukrainy wykonującego międzynarodowy transport drogowy w rozumieniu art. 4 pkt 2 ustawy z dnia 6 września 2001 r. o transporcie drogowym (Dz. U. z 2022 r. poz. 180 i 209) lub niezarobkowy międzynarodowy przewóz drogowy w rozumieniu art. 4 pkt 6 tej ustawy.
5. Jeżeli ostatni dzień okresu ważności zezwolenia na pobyt czasowy udzielonego obywatelowi Ukrainy przypada w okresie od dnia 24 lutego 2022 r., okres ważności tego zezwolenia ulega przedłużeniu z mocy prawa do dnia 31 grudnia 2022 r.
6. Jeżeli termin do opuszczenia przez obywatela Ukrainy terytorium Rzeczypospolitej Polskiej, o którym mowa w art. 299 ust. 6 ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach, przypada w okresie od dnia 24 lutego 2022 r., ulega on przedłużeniu z mocy prawa o okres 18 miesięcy. W okresie, na który termin został przedłużony, nie stosuje się przepisów art. 99 ust. 1 pkt 9, art. 196 ust. 1 pkt 5 oraz art. 213 ust. 1 pkt 6 ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach.
7. Jeżeli termin dobrowolnego powrotu, o którym mowa w art. 315 ust. 1 ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach, określony w decyzji wydanej wobec obywatela Ukrainy, przypada w okresie od dnia 24 lutego 2022 r., ulega on przedłużeniu z mocy prawa o okres 18 miesięcy. W okresie, na który termin został przedłużony, nie stosuje się przepisów art. 99 ust. 1 pkt 8, art. 196 ust. 1 pkt 4 oraz art. 213 ust. 1 pkt 5 ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach.
8. Jeżeli ostatni dzień okresu ważności:
1)kart pobytu,
2)polskich dokumentów tożsamości obywatela Ukrainy,
3)dokumentów "zgoda na pobyt tolerowany"
- wydanych obywatelom Ukrainy przypada w okresie od dnia 24 lutego 2022 r., ulega on przedłużeniu z mocy prawa o okres 18 miesięcy.
9. Przedłużenie okresu ważności dokumentów, o których mowa w ust. 8, nie stanowi podstawy do wydania lub wymiany tych dokumentów.
10. Karta pobytu w okresie, na jaki uległ przedłużeniu okres jej ważności na podstawie ust. 8, nie uprawnia do przekraczania granicy.
11. Jeżeli ostatni dzień dopuszczalnego okresu pobytu obywatela Ukrainy na terytorium Rzeczypospolitej Polskiej:
1)na podstawie wizy Schengen wydanej przez organ polski,
2)na podstawie wizy wydanej przez inne państwo obszaru Schengen,
3)na podstawie dokumentu pobytowego, o którym mowa w art. 1 ust. 2 lit. a rozporządzenia Rady (WE) nr 1030/2002 z dnia 13 czerwca 2002 r. ustanawiającego jednolity wzór dokumentów pobytowych dla obywateli państw trzecich (Dz. Urz. UE L 157 z 15.06.2002, str. 1, z późn. zm.), wydanego przez właściwy organ innego państwa obszaru Schengen, albo innego dokumentu pobytowego wydanego przez organ tego państwa, uprawniającego do podróży po terytorium innych państw tego obszaru,
4)w ramach ruchu bezwizowego
- przypada w okresie od dnia 24 lutego 2022 r., a pobyt ten rozpoczął się przed tym dniem, jego pobyt na tym terytorium uznaje się za legalny przez okres 18 miesięcy.

Extension of periods of legal residence of citizens of Ukraine in the territory of the Republic of Poland
ENGLISH VERSION
Art. 42 [Extension of periods of legal residence of citizens of Ukraine in the territory of the Republic of Poland].
1. If the last day of the period of stay of a citizen of Ukraine in the territory of the Republic of Poland on the basis of a national visa falls in the period from 24 February 2022, the period of stay on the basis of this visa and the period of validity of this visa shall be extended by law until 31 December 2022.
2. In the case referred to in paragraph 1, no new visa sticker shall be affixed to the travel document of the citizen of Ukraine.
3. A national visa during the period of extension of the period of stay and the period of validity under paragraph 1 shall not entitle to cross the border.
4. The provisions of paragraphs 2 and 3 shall not apply to a driver who is a citizen of Ukraine performing international road transport within the meaning of Article 4 point 2 of the Act of 6 September 2001 on road transport (Journal of Laws of 2022, item 180 and 209) or non-commercial international road transport within the meaning of Article 4 point 6 of that Act.
5. If the last day of the period of validity of a temporary residence permit granted to a citizen of Ukraine falls within the period from 24 February 2022, the period of validity of this permit shall be extended by law until 31 December 2022.
6. If the term to leave the territory of the Republic of Poland by a citizen of Ukraine referred to in Article 299(6) of the Act on foreigners of 12 December 2013 falls in the period from 24 February 2022, it shall be extended by operation of law for a period of 18 months. During the period for which the term has been extended, the provisions of Article 99(1)(9), Article 196(1)(5) and Article 213(1)(6) of the Act on Aliens of 12 December 2013 shall not apply.
7. If the deadline for voluntary return referred to in Article 315(1) of the Act of 12 December 2013 on foreigners, specified in the decision issued to a citizen of Ukraine, falls within the period from 24 February 2022, it shall be extended by law for a period of 18 months. During the period for which the term has been extended, the provisions of Article 99(1)(8), Article 196(1)(4) and Article 213(1)(5) of the Act on Aliens of 12 December 2013 shall not apply.
8. If the last day of the validity period:
1) residence cards,
2) Polish identity cards of a citizen of Ukraine,
3) documents "permit for tolerated stay
- issued to citizens of Ukraine fall within the period from 24 February 2022, shall be extended by law for a period of 18 months.
9. Extension of the period of validity of the documents referred to in paragraph 8 does not constitute a basis for issuing or replacing these documents.
10. A residence card shall not entitle its holder to cross the border during the period for which its validity has been extended under section 8.
11. If the last day of the permissible period of stay of the citizen of Ukraine in the territory of the Republic of Poland:
1) on the basis of Schengen visa issued by the Polish authorities,
2) on the basis of a visa issued by another Schengen State,
3) on the basis of a residence permit, referred to in Article 1(2)(a) of the Council Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals (OJ L 157, 15.6.2002, p. 1, as amended) issued by the competent authority of another Schengen State or another residence permit issued by an authority of that State, entitling to travel within the territory of other states of the Schengen Area,
4) within the framework of visa-free travel
- falls in the period from 24 February 2022, and the stay began before that date, his/her stay on the territory shall be considered legal for a period of 18 months.
